STANDARD TERMS AND CONDITIONS OF SALE

  1. The customer explicitly waives their own standard terms and conditions, even if these were drafted after these standard terms and conditions of sale. To be valid, any waiver must be expressly agreed upon in writing and in advance.
  2. Our invoices are payable within 21 business days, unless another payment term is specified on the invoice or in the order. In the event of non-payment by the due date, The Machine reserves the right to request a fixed interest payment equivalent to 10% of the remaining amount owed. The Machine will be authorized to suspend any provision of services without prior notice in the event of a payment delay.
  3. If a payment remains outstanding for more than sixty (60) days after the due date, The Machine reserves the right to engage the services of a debt recovery company. All legal fees will be payable by the client.
  4. Some countries apply withholding taxes on the amount of invoices, according to their internal legislation. Any withholding tax will be paid by the client to the tax authorities. Under no circumstances shall The Machine be involved in costs related to the legislation of a country. Therefore, the amount of the invoice will be due to The Machine in its entirety and will not include any costs related to the legislation of the country in which the client is located.
  5. The Machine is committed to doing everything possible to provide efficient services on time in accordance with the agreed deadlines. However, none of its obligations can be considered as an obligation to achieve results. The Machine cannot, under any circumstances, be required by the client to appear as a third party in the context of any damage claim brought against the client by a final consumer.
  6. To be admissible, The Machine must be notified of any claim by a letter sent by certified mail to its registered office within 8 days following the delivery of goods or the provision of services.
  7. All our contractual relationships will be governed exclusively by Spanish law.
